These Terms of Service govern your access to and use of the NAVA VISION website, online store, products, content, features, tools, and related services collectively referred to as the “Services.”

Throughout these Terms, the words “we,” “us,” and “our” refer to NAVA VISION and its legal operator, WZLCD LLC. The words “you” and “your” refer to any visitor, customer, purchaser, or other user of the Services.

By visiting our website, creating an account, placing an order, or otherwise using the Services, you agree to these Terms of Service and to any policies referenced within them. If you do not agree, you must not use the Services.

✅ 1. Eligibility and Acceptance

You must be at least the age of majority in your place of residence to make a purchase, or you must use the Services with the permission and supervision of a parent or legal guardian.

By placing an order, you represent that:

  • The information you provide is accurate and complete

  • You are authorized to use the selected payment method

  • Your purchase is for lawful purposes

  • You will comply with these Terms and all applicable laws

You may not use our products or Services for any illegal, fraudulent, abusive, or unauthorized purpose.

We make reasonable efforts to present product descriptions, dimensions, materials, specifications, features, colors, photographs, availability, and pricing accurately.

However:

  • Colors may appear differently depending on your screen or device

  • Measurements may have reasonable manufacturing tolerances

  • Packaging, components, or minor design details may change without materially affecting the product

  • Product images may include accessories or surrounding items that are not included unless specifically stated

  • Product availability may change without notice

Customers are responsible for reviewing the complete product description, dimensions, specifications, weight capacity, assembly requirements, and other relevant information before purchasing.

🪑 3. Assembly and Safe Product Use

Certain products may require assembly. Customers must follow all instructions, warnings, weight limits, maintenance recommendations, and safety guidance supplied with the product.

You are responsible for:

  • Ensuring that assembly is completed correctly

  • Using the correct parts and tools

  • Tightening and checking components periodically

  • Using the product only for its intended purpose

  • Keeping the product on a suitable and stable surface

  • Discontinuing use if damage, instability, or missing components are discovered

Products must not be improperly modified, overloaded, misused, or assembled using unauthorized replacement parts.

Professional assembly should be considered when the customer is unable to safely complete the assembly process.

Nothing in this section excludes responsibility that cannot legally be excluded.

💵 4. Prices, Taxes and Charges

All prices are displayed in the currency shown on the website, normally United States dollars, unless otherwise stated.

Prices may change at any time before an order is placed. A price change does not affect an order that has already been accepted, except where the displayed price resulted from an obvious error.

Applicable sales taxes, shipping costs, duties, or other charges will be displayed during checkout whenever reasonably possible.

International customers may be responsible for customs duties, import taxes, brokerage fees, or similar government charges unless checkout specifically states that such charges are included.

Available payment methods are displayed during checkout and may vary according to location, device, order value, and payment-provider availability.

By submitting payment information, you represent that:

  • You are authorized to use the payment method

  • The billing information is accurate

  • Sufficient funds or credit are available

  • The payment provider may process the applicable charge

Payments are processed through Shopify and authorized third-party payment providers. We do not directly store complete payment-card information on our own systems.

Payment authorization does not guarantee order acceptance. Orders may be subject to fraud screening, identity verification, or additional security checks.

📦 6. Orders and Order Acceptance

Submitting an order constitutes an offer to purchase the products listed in the order.

An automated order confirmation acknowledges that we received your order but does not necessarily mean that the order has been finally accepted.

We may decline, limit, hold, or cancel an order for legitimate reasons, including:

  • Product unavailability

  • Incorrect product or pricing information

  • Payment failure

  • Suspected fraud or unauthorized activity

  • Delivery restrictions

  • Duplicate or unusually large orders

  • Violation of these Terms

  • Errors affecting the order

If we cancel an order after payment has been collected, the applicable amount will be refunded to the original payment method.

We may limit quantities purchased by a single customer, household, account, payment method, or delivery address.

🚚 7. Processing, Shipping and Delivery

Orders are generally processed within 1–3 business days.

Estimated delivery times are:

  • United States: 6–12 business days

  • International destinations: 7–15 business days

Delivery estimates begin after order processing and are not guaranteed arrival dates.

Delivery may be affected by carrier disruptions, weather, customs procedures, incorrect addresses, remote locations, public holidays, supply interruptions, or circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address. We are not responsible for delays or additional costs caused by incorrect or incomplete customer-provided information.

Risk of loss and legal title transfer according to applicable law and the delivery arrangement used for the order.

🔄 8. Returns, Refunds and Final Sale Products

Eligible products may be returned within 30 days of delivery, subject to the conditions stated in our Return and Refund Policy.

Approved returns include:

  • Free return shipping

  • No restocking fee

Products clearly identified as Final Sale before purchase are not eligible for standard returns, except where the product is defective, damaged, incorrect, materially misdescribed, or where applicable law requires otherwise.

Our Return and Refund Policy forms part of these Terms and provides the complete eligibility requirements and return procedures.

❌ 9. Order Cancellations

Cancellation requests should be submitted as soon as possible after an order is placed.

We will make reasonable efforts to cancel an order before processing or shipment begins. Cancellation cannot be guaranteed once fulfillment has started.

If an order has already shipped, the customer may request a return after delivery in accordance with the Return and Refund Policy.

🏷️ 10. Promotions and Discount Codes

Promotions, discounts, gifts, and coupon codes may be subject to separate conditions, including:

  • Start and expiration dates

  • Minimum purchase requirements

  • Product exclusions

  • Customer or usage limits

  • Geographic restrictions

Unless otherwise stated:

  • Discount codes cannot be combined

  • Discounts cannot be applied retroactively

  • Discounts have no cash value

  • Promotions may be modified or ended before an order is placed

  • Fraudulent or unauthorized use may result in cancellation

A discounted item is not automatically considered Final Sale unless it is clearly marked as such before purchase.

You may be permitted to create a customer account.

You are responsible for:

  • Providing accurate information

  • Maintaining the confidentiality of login credentials

  • Restricting access to your device and account

  • Informing us promptly of suspected unauthorized use

You are responsible for activity occurring through your account unless prohibited by applicable law.

We may suspend or terminate accounts used for fraud, abuse, unauthorized activity, or material violations of these Terms.

By using the Services, you consent to receive necessary electronic communications relating to:

  • Orders

  • Payments

  • Delivery

  • Returns and refunds

  • Account security

  • Customer-support inquiries

  • Changes affecting the Services or policies

Transactional communications are separate from promotional marketing.

You may unsubscribe from promotional emails through the unsubscribe link included in those messages. Unsubscribing from marketing will not prevent necessary order or service communications.

When you submit a review, photograph, comment, suggestion, or other content, you confirm that:

  • You own the content or have permission to provide it

  • The content is truthful and based on genuine experience

  • It does not violate another person’s rights

  • It is not unlawful, deceptive, threatening, defamatory, obscene, or malicious

  • It does not contain harmful code, spam, or unauthorized advertising

You grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, adapt, and distribute submitted content for operating and promoting the Services, subject to applicable law.

We may moderate or remove content that violates these Terms, but we are not required to publish every submission.

The Services and their content—including the NAVA VISION name, logos, graphics, text, photographs, product descriptions, videos, designs, layouts, and software—are owned by or licensed to us and are protected by applicable intellectual-property laws.

You may use the website only for personal and lawful shopping purposes.

Without prior written permission, you may not:

  • Copy or reproduce website content

  • Use our branding or product content commercially

  • Modify, distribute, sell, or republish our materials

  • Scrape or automatically extract store data

  • Create misleading associations with our brand

  • Remove copyright, trademark, or ownership notices

Nothing in these Terms transfers ownership of our intellectual property to you.

Where liability cannot legally be excluded, our liability will be limited only to the maximum extent permitted by applicable law.

Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, gross negligence, personal injury caused by negligence, or any other responsibility that cannot lawfully be excluded or limited.

To the extent permitted by law, you agree to indemnify and hold WZLCD LLC and its service providers harmless from third-party claims, damages, liabilities, and reasonable expenses arising from:

  • Fraudulent or intentionally harmful activity

This provision does not apply where a claim results from our own unlawful conduct or where indemnification is prohibited by law.

Termination does not affect rights, payment obligations, liabilities, or provisions that arose before termination or that are intended to survive it.

These Terms are governed by the laws of the State of New Mexico, United States, without regard to conflict-of-law principles.

Any dispute will be handled by courts with appropriate jurisdiction, subject to any mandatory consumer-protection rights or local laws that apply to the customer and cannot legally be waived.

Before initiating formal proceedings, the parties are encouraged to attempt to resolve the matter through good-faith communication.

📄 25. Entire Agreement and Waiver

These Terms, together with our Privacy Policy, Shipping Policy, Return and Refund Policy, and any other policies referenced on the Services, constitute the entire agreement governing your use of the Services.

Our failure to enforce a provision does not waive our right to enforce it later.

Headings are provided for convenience and do not alter the interpretation of these Terms.

The updated version will be posted on this website with a revised Last updated date.

Changes apply prospectively from the date they are published unless applicable law requires otherwise.
